Purpose of Data Collection

Before joining our company or during the application process, we process your personal data exclusively for the purpose of establishing a contractual relationship to the extent required. Legal bases for the processing of your personal data are in particular:

  • for the establishment, performance and termination of a contractual relationship pursuant to Art. 6 (1) lit. b) such as contact and qualification data;
  • for the fulfillment of a legal obligation according to Art. 6 para. 1 lit.c), in particular of a fiscal nature and for health and social insurance purposes;
  • on the basis of consent from you by voluntarily providing data that is not absolutely necessary for the purpose (such as hobbies in a resume)
  • as well as in case of processing for the protection of a legitimate interest according to Art. 6 para. 1 lit. f) for data which are not subject to the above-mentioned legal bases;

(however, such data is generally not required for the conclusion of a contract or the continuation of an existing contract) pursuant to Art. 6 (1) (a), Our legitimate interests in this regard lie in, for example:

  • the optimization of the application processes,
  • ensuring compliance with safety regulations, requirements, industry standards and contractual obligations,
  • the assertion, exercise or defense of legal claims,
  • the prevention of damage and/or liability to the company by taking appropriate measures.

Types of Data processed by us

The following personal data will be collected, processed and stored:

  • Applicant data; Name, date of birth, CV, nationality/work permit, etc. for the processes of selection, hiring, managing the entry and leaving the company,
  • Private contact data; Address, phone number, e-mail (for contacting),
  • Data in connection with the screening of personnel (e.g. clearance certificate, reliability test),
  • If so, data subject to a professional secret; For example, data on the health aptitude and possible restrictions,
  • Other data within personnel administration; Severe disability (as far as relevant), driving license

We require no data whatsoever which are not exploitable according to the Law on General Non-discrimination (Allgemeines Gleichbehandlungsgesetz) (race, ethnical origin, sex, religion or world views, disability, age, sexual orientation). Please submit no information on diseases, pregnancy, ethnical origin, political views, philosophical or religious convictions, union membership, physical or mental sanity or sexual life. The same goes for contents fit to infringe the rights of third parties (e.g. copy rights, press law, or general claims of third parties).

Deletion Period

After achieving the respective purpose your data will be deleted. However, data will be stored for as long as necessary to defend legal claims, respectively claims on the base of general terms and conditions. Generally, this will be 6 months, unless your profile has been sent to us by an employment agency and causes commission claims of that agency for more than 6 months. As far as accounting related processes were initiated, as, for example, the reimbursement of travelling expenses, the data relevant for this will be deleted observing the statutory record retention periods, generally 6 or 10 years.

As far as the application was successful and a contract was concluded, we will transfer the data collected during the application process into our personnel file.
